Prices:
All prices are quoted in New Zealand Dollars. Prices are subject to change due to currency fluctuation or other factors outside our control, until final payment has been received. We reserve the right to surcharge the price after full payment for circumstances beyond our control such as the imposition of new or amended Government charges. Costs associated with passports, vaccinations, insurance, meals (other than those stipulated), optional activities, excess baggage, emergency evacuation costs, and all items of a personal nature are not included.
Deposits and Final Payments
A non-refundable deposit of $250 per person is required at the time of booking.
Receipt of deposit by China Business Tours will be taken as an understanding by us that you have read and agree to abide by the terms and conditions set forth on this website and the booking form. Final payment is due 30 days before tour
commencement. If we do not receive final payment by the due date we are
entitled to assume that you have cancelled your booking and cancellation fees will apply. Payments may be made by bank transfer or cash.
Cancellations and Refunds
All cancellations must be received in writing. Cancellation fees are levied as follows:
- More than 30 days before departure – loss of deposit
- From 30-2 days before departure – $500 per person
- Less than 2 days before departure – 100%
To the extent permitted by law, no refund is available for cancellations after the travel has commenced or in respect of any tours, accommodation, meals or any other services not utilised.
Insurance
Travel insurance is mandatory for our tour participants and it is the traveller’s responsibility to ensure they have read and understood their travel insurance policy cover and any exceptions or exclusions contained therein. We strongly recommend that travel insurance is purchased at the time of reservation and payment of deposit.
Unavoidable Extraordinary Circumstances (Force Majeure)
If your travel arrangements cannot proceed due to flood, earthquake, war or civil strife, acts of terrorism, hurricane, cyclone, industrial disturbance, strike, fire, lock-out, epidemic, pandemic, failure or delays of scheduled transportation, or any law, order, decree, rule or regulation of any government authority (including quarantine requirements or government travel advisories), or for any other reason beyond our reasonable control (Force Majeure),we may elect to reschedule or cancel your travel arrangements. In this case, neither party will have any claim for damages against the other. However, we will refund payments made by you less unrecoverable third-party costs and less fair compensation for work undertaken by us up until the time of termination and in connection with the processing of any refund. We will not be responsible to you for any expenses or loss you incur in connection with your booking if your travel arrangements are rescheduled or cancelled whether or not due to Force Majeure.
In the event of an advice being posted on the NZ Government Safe Travel website (www.safetravel.govt.nz) declaring ‘Do Not
Travel’ to China, China Business Tours reserves the right to cancel the entire itinerary. In this event, we will attempt to recover as much refund as possible on behalf of the traveller for unused services resulting from the cancellation, but will not be liable for any unrecoverable costs or fees charged by any supplier.
Pandemic/Covid Policy
If you test positive for Covid-19 or any other WHO designated pandemic infection while travelling with us, you will need to comply with the legislation or regulations of the country you are in and may not be able to continue to travel with the group. For the health and safety of your host and fellow travellers you may be required to complete a period in isolation until you no longer test positive. Any additional costs incurred as a result of isolation would be your own responsibility, including but not limited to, the cost of any additional accommodation, travel, medical costs, or any costs associated with having to return home early or to re-join the tour, and any incidental expenses. Refunds will not be provided to any traveller who cannot fulfil the entirety of their programme due to Covid-19 or any other WHO designated pandemic illness once the tour has commenced.
Travel Documentation
The name provided in the reservation must match the full name as per your passport, which must be valid for a minimum of six months after your scheduled date of return. A copy of your passport must be provided at the time of booking. In most cases a Chinese visa or APEC Business card is required for entry into China. Please check the requirements pertaining to your passport with the Chinese Embassy or travel agent. It is your responsibility to have a valid passport and any visas, re-entry permits and/or health regulations which meet the requirements of immigration and other government authorities.
Health & Medical Requirements
It is important for us to know and a condition of accepting your booking that you advise us at the time of booking of any health or medical conditions that could affect your ability to participate in the tour. Our tours include a level of walking and all participants must be able to easily walk a minimum of 5km without aid. If you have any concerns over the suitability of the proposed travel arrangements, we recommend that you contact your medical practitioner to discuss the travel to be undertaken. You must also promptly advise us if there are any changes to your health that may affect your travel after your booking has been confirmed.
Acceptance of Risk
You acknowledge that travel involves personal risks which may be greater than those present in your everyday life. This could be as a result of the adventurous nature of your trip or the visiting of destinations which present geographical, political or cultural risks and dangers. You should consult guidance issued by the Ministry of Foreign Affairs and Trade (www.mfat.govt.nz) applicable to the destinations within your itinerary. You acknowledge that your choice to travel is made having had the benefit of MFAT guidance, and you accept any additional personal risks associated with your travel. To the fullest extent permitted by law, we disclaim any liability for these risks.
Tour Variation
If unforeseen circumstances beyond our control require us to make necessary changes to your holiday, we reserve the right to cancel or reschedule/defer departures and itineraries. When it is necessary to change a hotel, we reserve the right to substitute accommodation of at least a similar standard. China Business Tours is not liable for any additional costs incurred in any changes beyond our control.
Business Purposes
You agree that where our services are acquired for business purposes, or where you hold yourself out as acquiring our services for business purposes, the Consumer Guarantees Act 1993 will not apply to any supply of goods or services made under these conditions.
Governing Law
This agreement is covered by the laws of New Zealand. Any claim or legal action against overseas suppliers is likely to be subject to the terms of our contract with them, and may be governed by the laws of other countries.
Responsibility
China Business Tours accepts bookings subject to the following conditions:
(a) China Business Tours acts as a co-ordinator for all persons taking the tour in the making of all arrangements for transport, sightseeing and accommodations none of which are owned, managed, controlled or operated by us.
(b) China Business Tours only acts as an agent for the owners, contractors and suppliers of transport and/or other related travel services provided and assumes no responsibility for the loss or damage to property or for injury, illness or death or for any damages or claims however so caused arising directly or indirectly from accidents, loss or damage to person or property, delays, transport failures, strikes, wars, uprisings or acts of God over which we have no control.
(c) While we will use our best endeavours to operate all tours as advertised, reasonable changes in the itinerary may be made without notice where deemed necessary by us.
(d) China Business Tours makes every effort to ensure the accuracy of the information on this site but cannot be held responsible for any errors or omissions that may occur. Photographs and descriptions of locations or attractions are merely representative of conditions that existed at time of publication and conditions may not be the same at the time of your journey.
Disclaimer of Liability
To the maximum extent permitted by law, China Business Tours shall not be responsible or liable for cancellations, acts of other service providers, diversions or substitution of equipment or any act, variation, postponement, omission or default by air carriers, land carriers, hoteliers or hotels, transportation companies, or any other persons providing services or accommodations to guests including any results thereof, such as changes in services, accommodations or facilities. Nor shall they be liable for loss or damage to baggage or property, or for any damages or claims whatsoever arising from loss, negligence or delay from the act, error, omission default or negligence of any person not its direct employee or under its exclusive control, including any act, error, omission, default, or negligence of any country, government or governmental authority, officer or employee. China Business Tours shall not be liable for indirect, special or consequential damages.
Refusal of Carriage
China Business Tours reserves the right to remove customers from our tours for reasons that impact on the enjoyment or safety of other tour embers, such as, but not limited to, the physical, medical or mental inability of customers to undertake the arrangements of the tour, unsocial or unruly behaviour, or the carriage of prohibited substances and materials. You will not be entitled to any refund for unused services and you will be responsible for any additional costs you incur.
